Website build agreement
These terms have not yet had independent legal review.
This agreement is between AutoSocials AI Pty Ltd, ABN 35 697 536 780 and ACN 697 536 780, Queensland, Australia, which we call AutoSocials, and the client named in the signup, which we call you. It applies together with the current AutoSocials privacy policy and any written quote that we both accept.
1. Scope
We will design and build the website tier selected in your signup using the brief, current website material and brand direction you approve. The site will be mobile responsive, SSL secured and staged on a private preview address before launch. Integrations or bespoke features outside the selected tier require a written quote.
2. Human and AI managed delivery
Your project is managed by a team of humans and AI. AI tools assist with design, copy and imagery so we can charge less than a conventional agency. Client-visible work remains subject to human review while each delivery stage earns approval to run without that gate.
3. Timing, Priority and client feedback
Standard targets five working days and Premium targets seven working days. Either may be completed sooner. Flagship timing is dated in its written quote. The project clock starts only after we have received the deposit, completed onboarding, required content, assets and access. It pauses while a required decision or item is with you. Delivery targets are estimates rather than guarantees.
48-Hour Priority is available only after capacity is confirmed. It costs $499 GST inclusive for Standard and $999 GST inclusive for Premium. It moves the project above the normal queue and uses shorter internal review windows. Every quality and testing requirement remains unchanged. The 48 hours begins only when the project is build-ready.
4. Revisions
Revisions continue until you are happy and approve the site, provided your requests remain within the confirmed content, functions and design scope. You provide feedback through point-and-click pins with prepared choices and an optional Other field when those choices do not cover your request. Corrections to our errors, broken functions or incorrectly transferred facts are always included.
New pages, new functions or a changed brief are scope changes and must be confirmed before that work begins. After a Standard build begins, a complete direction reset and site rebuild is also a scope change. Premium and Flagship include a complete direction reset and rebuild when needed for approval, provided the original content and functional scope remains unchanged.
5. Fees and payment
Prices are in Australian dollars and every price stated in this agreement includes GST. Standard and Premium use the prices shown when you sign up. Flagship is by quote, with no fixed or starting price. On the five-week payment plan, the first payment is the deposit that locks a build slot. The remaining four payments are charged weekly. On the upfront plan, the advertised upfront price applies. The deposit is credited against the build price.
Work does not begin until this agreement is accepted and the deposit is confirmed. If you cancel before the first draft is delivered, we refund the deposit less the value of work reasonably performed. If you cancel after the first draft is delivered, the deposit is not refunded because the work exists. We may pause work and hosting on an overdue account after reasonable written notice.
Monthly services selected with your website
Hosting and security costs $53.90 per month including GST. Optional website care costs $53.90 per month including GST. Optional ongoing SEO costs $218.90 per month including GST ($199 plus GST). Optional AutoSocials Starter social posting costs $79 per month including GST. Your order summary records the services you selected and their total. These charges are separate from the website build price and its deposit or balance.
AI SEO includes a monthly search-performance review, Google Gemini-assisted research and content recommendations, continued technical and on-page improvements, and one agreed priority content optimisation each month. AutoSocials reviews changes before publishing and provides this service independently of Google. SEO supports long-term visibility, but search positions, traffic and enquiry results are not guaranteed.
Monthly charges start when your website goes live. By accepting the agreement and paying your deposit, you authorise us to save your payment card and charge that card for your selected services each month from launch. No monthly service fee is charged with the deposit. Contact us before launch if your selected services need to change.
You can cancel optional website care, ongoing SEO or social posting at any time by contacting hello@autosocials.com.au. Cancellation stops future renewals. Hosting continues while we host your website and can end when hosting ends. Your social setup opens after the deposit so you can confirm your brand, add approved photos and connect your social accounts. Scheduled posting starts once the website is live, social onboarding is complete and monthly billing is active.
6. Your material and factual approval
You confirm that information you give us is accurate and that you own or are licensed to use supplied logos, photos, menus, text and other material. We will not knowingly invent awards, prices, years in business or other factual claims. You must review the final copy and facts before approval.
7. Intellectual property and portfolio
Once the build is paid in full, you receive the agreed rights to the completed site and its client-specific content. We retain our underlying components, tools and design system. You allow us to show a screenshot and link in our portfolio and to include a discreet Website by AutoSocials footer credit. You may opt out of the footer credit in writing.
8. Hosting, domains and DNS
Your domain always remains yours. For an existing domain, the standard launch asks you to add a CNAME or equivalent record. Your nameservers, MX records and email do not move. Where we register a new domain for you, you are always recorded as the registrant and can transfer it out without a transfer fee from us. Hosting has no guaranteed service level unless a separate agreement says otherwise.
9. Third parties
Cloudflare, Stripe, booking systems and other third-party services have their own terms and availability. We are not responsible for an outage or policy change outside our reasonable control, but we will take reasonable steps to restore service or provide an alternative.
10. Privacy and records
We handle signup, audit and contact information in line with our privacy policy. The click-wrap record includes your typed name, consent, time, an IP-derived hash, browser details, the cryptographic hash and the full snapshot of the terms displayed.
11. Australian Consumer Law and liability
Nothing in this agreement excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Subject to those rights and to the extent the law allows, our liability under this agreement is capped at the fees paid under it. We exclude liability for indirect or consequential loss to the extent the law allows.
12. Ending the project
Either party may end the project for a material breach that is not fixed after reasonable written notice. If you are silent for 60 days, we may close the project after written reminders. When we close a silent project under this section, amounts already paid become a credit toward restarting the same project within twelve months.
13. Governing law
